Obtaining U.S. Citizenship
Obtaining U.S. citizenship is the ultimate dream for many immigrants. The process can vary in duration, from a few years to over a decade, and may involve transitioning through several immigration stages. Patriot Immigration Law Group is here to guide you through your immigration journey.
Typically, after 5 years as a lawful permanent resident (green card holder), one can apply for U.S. citizenship. This process is generally simpler than obtaining a green card. Spouses of U.S. citizens can apply after only three years, and lawful permanent residents who have served in the military can apply after just one year.
Patriot Immigration Law Group can advise you concerning what stage you are in your immigration journey, or even help you get started.
American citizenship eligibility conditions
For the majority of individuals, the requirements are as follows :
- The permanent resident is at least 18 years of age, though applicants under age 18 can derive citizenship from naturalized parents.
- The individual has been a permanent resident for at least 5 years.
- The permanent resident has been a continuous resident for the last 5 years.
- The permanent resident has lived in the Citizenship and Immigration Services (USCIS) district where they claim residence for at least 3 months before filing.
- The permanent resident has demonstrated physical presence in the United States for at least 30 months (913 days), during the last 5 years.
- The permanent resident demonstrates good moral character.
- The permanent resident demonstrates an attachment to the principles of the U.S. Constitution.
- The permanent resident demonstrates a basic knowledge of U.S. history and government (also known as “civics”) as well as an ability to read, write, speak, and understand basic English.
- The permanent resident is willing to take the Oath of Allegiance to the United States, and is well disposed to the good order and happiness of the United States.
As mentioned above, spouses of U .S. citizens can apply after only three years as a permanent resident, whereas members of the U.S. military can apply after only one year.
American citizenship advantages
- Citizenship is permanent unless voluntarily renounced, unlike a green card which needs to be renewed every 10 years.
- A citizen cannot be deported, unlike a permanent resident which is still subject to deportation for certain crimes or acts.
- U.S. citizens can vote, have expanded employment opportunities with the government and can serve on juries.
- US citizens have greatly increased options for sponsoring family members through family based petitions than permanent residents.
